Terms & Conditions

These general terms and conditions (the "Terms & Conditions") govern the use of Oman Telecommunication Company's SAOG ("Omantel") application and access to Omantel online services (the "Application") and / or (the "Online Services"). Omantel strongly advices that the person downloading and /or using this Application (the "User") shall carefully read these Terms & Conditions before using the Application and/or accessing the Online Services.

Continuing to use this Application, the User acknowledges that he/she did read and accept the Terms & Conditions provided below. If the User does not accept the and Omantel Corporate Information Security and Privacy Policy , the User should cease using the Application immediately.

Omantel reserves the right, without providing any prior notice to modify, amend or otherwise update these Term & Conditions from time to time as it deems fit such modifications, amendments or updates shall automatically be deemed part and parcel of these Term & conditions and binding on the User.

Without prejudice to the confidentiality obligations provided below, certain features in the Application require ascertaining User's location, by using these features User consents to such access to his/her location.

Disclaimer

While Omantel exerts all reasonable efforts to include accurate and up-to-date information on the Application, the information available on this Application is only for information and makes no warranties or representations as to its accuracy and sufficiency of such information. Services provided through the Application are provided "as is" without any warranties or representations of any kind whether express or implies, arising by law or otherwise including without limitation any implied warranty of merchantability or fitness for a particular purpose or any implied warranty arising out of course of performance, course of dealing or usage of trade.

Omantel offers a wide range of Services, and sometimes additional terms may apply. When you use a Omantel Service (for example, Your Profile, Gift Cards,  Omantel Video, Your Media Library,  Omantel devices, or Omantel applications) you also will be subjected to the guidelines, terms and agreements applicable to that Omantel Service ("Service Terms"). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control.

PRIVACY

Omantel is committed to protect  User's privacy. The provisions provided herein to govern privacy forms part of these Terms & Conditions. Omantel may change its privacy policy from time to time which changes will be effective from the date they are posted in the Application.

Collection, use, retention, disclosure, transfer, security and access of personal data will be in accordance with this Terms and Conditions, Omantel Corporate Information Security and Privacy Policy and anu applicable Law or Regulation  

It may be necessary for the User to provide Omantel with her/his personal information (Personal Data) when Users apply to Omantel Online Services and /or continue to use/order from Omantel Online Services. If User's Personal Data is incomplete or incorrect, Omantel may not be able to provide or continue to provide its services to User.

Customer agrees that her/his Personal Data provided to Omantel may be used and retained by Omantel and that Omantel may disclose and transfer (whether in Oman or Abroad) to Omantel Agents, contractors, any telecommunication operator, any third party service providers, any third party collection agencies, any credit reference agencies, any security agencies, any credit provides, banks, financial institutions, Omantel professional advisers, any other persons under a duty of confidentiality to Omantel and any of Omantel's actual or proposed assignees or transferees of Omantel rights with respect to Omantel use, disclosure, holding, processing, retaining or transferring such Personal Data for the purpose mentioned above.

ELECTRONIC COMMUNICATIONS

When you use Omantel Services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. Your consent will be obtained to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Omantel Services, such as our Message Center, and you can retain copies of these communications for your records. 

COPYRIGHT

All content included in or made available through any Omantel Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Omantel or its content suppliers and protected by United States and international copyright laws. The compilation of all content included in or made available through any Omantel Service is the exclusive property of Omantel and protected by Chinese and international copyright laws.

TRADEMARKS

Click here to see a non-exhaustive list of Omantel trademarks. In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Omantel Service are trademarks or trade dress of Omantel. Omantel's trademarks and trade dress may not be used in connection with any product or service that is not Omantel's, in any manner that is likely to cause confusion among Users, or in any manner that disparages or discredits Omantel. All other trademarks not owned by Omantel that appear in any Omantel Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Omantel.

PATENTS

One or more patents owned by Omantel apply to the Omantel Services and to the features and services accessible via the Omantel Services. Portions of the Omantel Services operate under license of one or more patents. 

YOUR ACCOUNT

You may need your own Omantel account to use certain Omantel Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Omantel does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the Omantel Services only with involvement of a parent or guardian. Parents and guardians may create profiles for teenagers in their Omantel Household. Omantel reserves the right to refuse service, terminate accounts, terminate your rights to use Omantel Services, remove or edit content, or cancel orders in its sole discretion.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages or violates any applicable regulations or Policies. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Omantel reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant Omantel a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Omantel and sub-licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Omantel for all claims resulting from content you supply. Omantel has the right but not the obligation to monitor and edit or remove any activity or content. Omantel takes no responsibility and assumes no liability for any content posted by you or any third party.

INTELLECTUAL PROPERTY COMPLAINTS

Omantel respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please follow our Notice and Procedure for Making Claims of Copyright Infringement.

APP PERMISSIONS

When you use apps created by Omantel, you may grant certain permissions to us for your device. Most mobile devices provide you with information about these permissions. 

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

OMANTEL SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH OMANTEL SERVICES ARE PROVIDED BY OMANTEL ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. OMANTEL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE OMANTEL SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH OMANTEL SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF OMANTEL SERVICES IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY LAW, OMANTEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OMANTEL DOES NOT WARRANT THAT OMANTEL SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH OMANTEL SERVICES,  OMANTEL'S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM OMANTEL ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, OMANTEL WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY OF OMANTEL SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY Omantel SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

DISPUTES

Any dispute or claim relating in any way to your use of any Omantel Service, or to any products or services sold or distributed by Omantel will be resolved  through the competent Omani Court.  

APPLICABLE LAW

By using any Omantel Service, you agree that the Omani Laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Omantel.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our pricing policy, posted on this site. These policies also govern your use of Omantel Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
